Terms of use

These terms of use (the “Terms”) govern your use of the 2forkids app (Android and iOS apps, web app, together the “App”) operated by HOME SPLIT HOME LLC (“2forkids”, “we”, “us”). Together with our Privacy policy, they form the whole agreement between you and us. By creating an account and using the App, you accept these Terms.

1. Who we are

HOME SPLIT HOME LLC is a Limited Liability Company with a share capital of €100,000, registered office at 1013 Centre Road, Ste 403S, Wilmington, DE 19805, New Castle County, USA, identified under no. 82-1587550 and represented by Martin Technology Investment LLC.

2. The 2forkids platform

2forkids is an information-sharing platform designed to support separated parents and families of children living in two homes. It provides tools to communicate, and to share custody arrangements, schedules, events, expenses, documents, photos and other information about the children, to help coordinate their shared lives.

The App is free to use. It is available on Android, on iOS once published on the App Store, and in a recent web browser. Only a few advanced services are paid for, with tokens (section 6). The App is intended for personal, non-commercial use.

3. Eligibility

You must be at least eighteen (18) years old and able to enter into a binding contract to create an account. By creating a family around one or more children, you confirm that you hold the parental authority or guardianship needed to do so and to share information and photos about those children under the law that applies to you.

A minor can only use the App through an access created by one of their legal representatives, who vouches for the minor’s proper use of the App and remains responsible for it.

4. Account and family

To create an account, you either:

  • fill in the required fields and give a valid e-mail address, which is verified with a code; or
  • sign in with your Google or Apple account, in which case we receive the information needed to create the account (name, e-mail address, identifier) from that service.

You agree to give truthful information and keep it up to date from your profile. You keep your password secret, as well as your PIN and recovery document, which protect access to your family’s encrypted content, and you tell us promptly at contact@2forkids.com if they are lost or disclosed. You are responsible for any use of your account until you have told us about such a loss or misuse. Each person may hold only one account and may not open an account in someone else’s name.

The first member of a family creates it and can invite other members (the other parent, a step-parent, relatives) by e-mail or QR code. Each member has an access profile that decides what they can see and change. We do not verify the information given at sign-up, other than the e-mail address, but we may suspend an account and ask for proof if we suspect false information or identity theft.

5. The services

Subject to these Terms, you can use in particular:

  • Custody schedule and calendar: a schedule co-managed with the other parent, day-swap requests, events and reminders.
  • Messaging: conversations between family members, end-to-end encrypted, time-stamped and sealed with an integrity fingerprint.
  • Shared expenses: expenses, splits, receipts, balance and settlements between parents.
  • Documents, photo album and lists: document vault, photo gallery with comments, shared lists.
  • Child profile, including an optional health sheet that is end-to-end encrypted.
  • Advanced services paid with tokens: certified conversation export, event check-in, AI courtesy analysis of messages (section 6).

AI features provide automatically generated suggestions that may be inaccurate: you remain solely responsible for the messages you send and the decisions you make. 2forkids gives no legal advice. A certified export attests the integrity of a conversation as recorded in the App; its weight as evidence is for the court to decide.

6. Plans, subscription, tokens and payments

6.0 Free plan and the 2forkids Premium subscription

You can use the App for free within the free plan:

  • 1 family per user;
  • 3 active conversations and 8 active members (children included) per family;
  • 300 MB of storage per family;
  • no sync with an external calendar and no summary views (custody split, expenses and reimbursements).

The “2forkids Premium” subscription (€6.99 per month, taxes included) lifts these limits, raises the family’s storage to 1 GB and includes the advanced services without spending tokens. A family benefits from it as long as one of its parents is subscribed. It is monthly and renews automatically; you can cancel it at any time from the store used (Google Play, App Store) or, for a web subscription, from the management link shown in the App. Cancellation takes effect at the end of the current period.

When the subscription ends, whatever goes beyond the free plan is paused, not deleted: you keep the first family you joined; in a family, the 3 most active conversations stay active (the others become read-only) and the 8 members who signed in most recently stay active (the family’s creator first). If the storage is over 300 MB, reminders are sent 1, 5 and 15 days after the end of the subscription; after 30 days the oldest files are moved to an archive, downloadable for 90 days (reminders 30, 15 and 1 day(s) before its deletion), then deleted. A new subscription reactivates everything that was paused and puts the archive back in the vault.

6.1 Tokens

Without a subscription, some advanced services are paid with tokens, a unit of use specific to the App. Tokens are sold in packs:

  • pack of 10 tokens: €1.99 (taxes included);
  • pack of 25 tokens: €3.99 (taxes included);

and are debited when you use the corresponding service:

  • certified conversation export: 5 tokens;
  • event check-in: 2 tokens;
  • AI courtesy analysis of messages: 1 token for 50 analysed messages, only if you turned this option on.

Pack prices and the cost of each service are shown in the App before any purchase or use. A pack is a one-off purchase that never renews. A subscriber is never charged tokens.

Tokens are attached to the account that buys them. They do not expire, have no cash value outside the App, and cannot be exchanged for money, transferred to another account or resold. They are lost if the account is deleted.

6.2 Payment

Purchases are in-app purchases paid:

  • on Android, through Google Play;
  • on iPhone and iPad, through Apple’s App Store;
  • on the web, through RevenueCat Web Billing, with payment processed by Stripe.

Each payment is subject to the terms of the store or provider used. 2forkids never has access to your card details. Tokens are credited as soon as the store or provider confirms the payment.

6.3 Withdrawal right and refunds

Tokens and the subscription are digital content and services supplied immediately after purchase. By confirming your purchase, if you are a consumer, you expressly ask for the contract to be performed immediately and acknowledge that you thereby lose your fourteen-day right of withdrawal, where the law provides for such a right.

Purchased tokens are not refundable, except where the law or the rules of the store used require it (for example a duplicate purchase made by mistake, or a service not provided for a technical reason attributable to 2forkids). Refund requests for a Google Play or App Store purchase follow that store’s procedure; for a web purchase or any difficulty, write to contact@2forkids.com.

If a paid service could not be provided for a technical reason (for example an export that fails), the tokens debited are credited back to your wallet (automatically for the certified export and the AI analysis, on request to support otherwise).

7. Your content

You remain the owner of the content you post (messages, photos, documents, information about the children). You are responsible for it and confirm that you have the right to share it, in the children’s interest. To provide the services, you grant HOME SPLIT HOME LLC, for as long as you use the App, a non-exclusive, royalty-free licence to store, back up, transmit and display your content to the authorised members of your family, and to adapt it technically (format, size, encryption) only as needed to run the App. End-to-end encrypted content remains unreadable to us.

Either parent, or any person with parental authority over a child featured in the App, may ask us to remove personal information about that child by writing to contact@2forkids.com. If a dispute arises about parental rights, we may, as a precaution, restrict access to the family concerned.

8. Code of conduct

You agree not to, directly or through others:

  • post or send anything defamatory, abusive, obscene, pornographic, offensive, violent, threatening, harassing, racist, discriminatory or inciting hatred or violence, or that encourages illegal activities;
  • impersonate anyone, open more than one account, or open an account for someone else;
  • post content you do not have the right to share, or that infringes the rights (including privacy and image rights) of others, in particular children;
  • use the App for commercial purposes, spam or unsolicited messages;
  • copy, modify, distribute, decompile or reverse engineer the App (except as allowed by law), extract a substantial part of its data (for example with robots), or try to bypass its security or access other people’s data;
  • upload viruses or any code that could damage the App or its users.

9. Intellectual property

Except for the content provided by users, HOME SPLIT HOME LLC holds all intellectual property rights in the App, its content (texts, images, logos, graphics, data) and the software and databases that run it. You receive a personal, non-exclusive, non-transferable right to use the App for its intended purpose, and no other right.

10. Personal data and advertising

We process your personal data as described in our Privacy policy. The App shows no advertising and we do not sell your data.

11. Account deletion, suspension and termination

You can end your relationship with 2forkids at any time, for any reason, by deleting your account:

  • in the App: Profile → Delete my account (a recent sign-in is required); or
  • by e-mail to contact@2forkids.com, sent from the account’s e-mail address.

What is erased, anonymised or kept is described on the Delete my account page. Content shared in the family (schedules, expenses, documents, messages sent) remains available to the other members, attributed to a “Deleted user”. Unused tokens are lost.

If you breach these Terms, or if we have serious reasons to believe it is necessary to protect the safety and integrity of 2forkids, other users or third parties, or to prevent fraud, we may limit your access, suspend your account temporarily or permanently, or terminate it. Where possible, we will tell you so that you can explain yourself.

12. Availability and changes to the service

We try to keep the App available 24 hours a day, 7 days a week, but access may be interrupted without notice for maintenance, updates, outages or network constraints. We may change, add or remove features; if a paid service is permanently discontinued, users will be told in advance.

End-to-end encrypted content can only be decrypted with the family key kept on members’ devices. If you lose access to all your devices without keeping your PIN or recovery document, we cannot restore that content.

13. Electronic communications

You agree to receive service communications (codes, invitations, notifications, information about your account and these Terms) by e-mail and in the App. Keep your e-mail address valid and up to date.

14. Disclaimer

The App is provided “as is” and “as available”. Information posted in the App is the sole responsibility of the user who posts it; we do not guarantee its accuracy or the identity of users, and we are not a party to the relationships between family members. To the extent permitted by law, we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits the rights consumers have under mandatory law.

15. Limitation of liability

To the extent permitted by law, HOME SPLIT HOME LLC is not liable for indirect, incidental, special or consequential damages arising from the use of, or inability to use, the App, the conduct of other users or the loss of content that cannot be decrypted. This does not exclude or limit liability that cannot be excluded or limited by law, such as liability for gross negligence or wilful misconduct.

16. Indemnification

To the extent permitted by law, you agree to indemnify HOME SPLIT HOME LLC against claims by third parties arising from content you posted or from your breach of these Terms.

17. Changes to these Terms

We may change these Terms to adapt to technical, commercial or legal developments. Changes are published with their date and notified in the App before they take effect; continuing to use the App means you accept the new Terms, which the App may ask you to accept expressly.

18. Governing law and disputes

If you are a user who usually resides in a Member State of the European Union, the laws of that Member State apply to any claim or dispute arising from these Terms, and you may bring your claim before any competent court of that State. In all other cases, you agree that the dispute will be resolved before a competent court of the State of Delaware (United States) and governed by the law of that State, without regard to its conflict-of-law rules.

Before any proceedings, please contact us at contact@2forkids.com so we can look for an amicable solution. EU consumers may also use a consumer mediator free of charge.

19. Miscellaneous

If a provision of these Terms is held invalid, the others remain in force. Our failure to enforce a provision is not a waiver of it. We may assign these Terms to a company that takes over the App, after informing you. Neither party is liable for a failure caused by force majeure. In case of a discrepancy between language versions, the French version prevails.
